Domestic violence defense starts with the charge and the order

Bring every emergency protective order, criminal protective order and family-court order to the consultation. They can differ in scope and duration. Domestic battery and corporal injury are different allegations
Penal Code section 243(e)(1) addresses battery involving specified intimate or family relationships. Section 273.5 concerns the willful infliction of corporal injury resulting in a traumatic condition on a qualifying person. The relationship, alleged contact and injury evidence all matter; the label “domestic violence” does not answer those questions by itself.
The complaint may include other allegations, such as threats, property damage or violation of an order. Review each charge separately and discuss prior cases with counsel. Do not assume that the absence of a severe injury ends the prosecution or that every relationship dispute supports the same offense.
Evidence that needs a careful review
The available record may include the 911 call, body-camera footage, photographs, medical records, witness statements and messages before and after the incident. Timing matters: an officer may arrive after the disputed contact, and a photograph may need context about when an injury occurred. Preserve complete conversations and original files rather than editing them into a favorable selection.
Depending on the facts, the defense may involve identity, accident, credibility, lack of proof of a required element or lawful self-defense. None should be assumed from a short description. Doug can compare the allegations against the evidence and discuss what further investigation is useful.
