A confrontation can produce very different charges
An argument, attempted strike or disputed physical encounter can lead to an assault or battery investigation. Assault, battery and aggravated allegations
Penal Code section 240 defines assault in terms of an unlawful attempt and present ability to inflict violent injury. Section 242 addresses unlawful force or violence against another person. Actual contact is therefore not the same issue in every charge.
Section 245 covers specified aggravated assault allegations, including particular weapon and force allegations. The object involved, how it was used, the charged subsection and any injury allegation require separate review. Do not assume all assault charges carry the same consequences.
Self-defense depends on the entire encounter
Potential self-defense or defense-of-another issues require attention to the perceived threat, the need for immediate force and whether the force used was reasonable. Counsel must also examine how the encounter began and continued. A belief that the other person behaved badly does not by itself establish a legal defense.
A recording may begin after the first threat or show only one angle. Witnesses may have different positions or may be describing different moments. Doug can review available video, statements, injury photographs and other evidence to identify what can be established and what remains disputed.
Other issues may include mistaken identity, accident, inconsistent accounts or insufficient proof of the alleged act. The defense should follow the evidence rather than force every case into a single explanation.

Assault and battery defense questions
What if nobody was seriously hurt? The absence of serious injury does not answer every assault or battery allegation. Counsel needs to identify the required elements of the actual charge.
Should I ask the other person to withdraw the allegation? Do not pressure or contact someone in violation of an order. Give relevant information to your lawyer so communications and evidence requests can be handled appropriately.
